End User Licence Agreement (EULA)

MEYER | PDF

§ 1 Important notices on version status, trial period and locked functions

Stable version, not an untested beta: MEYER | PDF 1.55.3 is provided as a stable Windows version. The free 60-day Pro trial period makes it possible to try out this version; it does not turn the program into an untested test or beta version. This does not entail any limitation of all manufacturer obligations solely on the basis of the designation “Testphase” (trial period).

Data backup: Before changes are made to important documents, in particular before redactions, batch processing and the overwriting of original files, independent backup copies must be made to a reasonable extent. Automatic recovery does not replace data backup. Details and the differing requirements for consumers and business customers/traders (Unternehmer within the meaning of § 14 BGB) are governed by §§ 9 and 16.

No autonomous safety-critical use: The software is not intended for the autonomous control of safety-critical installations or as a substitute for prescribed technical, structural-engineering or other specialist examinations. Use as intended to support construction planning, quantity take-off and billing remains permitted.

Cloud AI locked: In this shipped version, all cloud AI functions are technically locked. This covers the MEYER AI Manager, the connection of the user's own third-party provider keys and the retrieval of a TPM-based AI demo key. The AI-Bemasser designated as “Alpha” is likewise not part of the contract as an available cloud service. Local OCR remains usable.

Absence of charge and liability: For the Free Edition, which is free of charge, and for the Pro trial period, liability is governed by § 17.

Technical support for MEYER | PDF: info@meyer-edv.com

In the following, MEYER EDV GmbH is referred to as “MEYER EDV” and the contracting party to whom rights of use are granted is referred to as “user”.

§ 3 Scope, user groups and conclusion of contract

(1) This contract governs the provision and use of MEYER | PDF, including the proprietary program components and documentation supplied with it. For third-party components, the licence terms referred to in § 11 apply in addition and, where applicable, with priority.

(2) Consumer means any natural person who concludes the contract for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (§ 13 of the German Civil Code (BGB)).

(3) Business customer/trader (Unternehmer) means a natural or legal person or a partnership with legal capacity that, when concluding the contract, acts in the exercise of its commercial or independent professional activity (§ 14 BGB). The status of business customer/trader is not to be equated with the status of merchant (Kaufmann).

(4) This contract becomes part of the respective contract for provision of the software only through effective incorporation. For this purpose, the user must be informed of it before conclusion of the contract and must be given a reasonable opportunity to view and save it. The required consent is given in the ordering procedure or, as the case may be, in the procedure for provision free of charge. A EULA displayed for the first time after the purchase does not worsen the position under an already concluded contract without an effective amendment agreement.

The German EULA is made available upon publication of version 1.55.3 at https://www.meyer-edv.com/meyer-pdf/eula, and the English version at https://www.meyer-edv.com/meyer-pdf/eula-en, in each case as a web page and as a PDF for saving.

The German version prevails; the English version is a translation. Mandatory consumer protection remains unaffected by this. Both language versions bear the revision identifier “MEYER PDF EULA 1.55.3, Stand 05.11.2026”. Earlier versions remain retrievable at the stated addresses, each with its respective date. The order confirmation contains, as a PDF, the version applicable at the time the contract was concluded.

(5) The mere continued use of the software, silence or the installation of an update required for performance of the contract are not deemed to be consent to disadvantageous amendments to the contract.

(6) Individual agreements take precedence. The service description agreed at the conclusion of the contract and binding commitments remain authoritative. Mandatory statutory rights are not restricted by this contract.

(7) Seller and licensor. In the case of a purchase for payment via our online shop, Polar Software Inc., 3500 South DuPont Highway, Dover, DE 19901, USA (“Polar”) is the contracting party to the purchase contract and the seller; Polar handles the order, payment, invoicing and value added tax. MEYER EDV is the manufacturer and licensor and owes the grant of the rights of use, licence activation, the updates promised under § 10 and its own expressly promised services. This contract does not restrict claims against Polar. For the Pro trial period and the Free Edition, MEYER EDV is the contracting party. A licence acquired for payment is not deemed to be provision free of charge, including in relation to MEYER EDV; § 17 does not apply to it.

(8) The provision of productivity software without age restriction does not replace the statutory requirements of legal capacity. In the case of persons with limited legal capacity, the required consents of the statutory representatives must be obtained.

§ 4 Subject matter of the contract and technical requirements

(1) MEYER | PDF is locally executed Windows desktop software for processing PDF files. Depending on the edition, it comprises in particular:

  • viewing, searching, commenting and printing;
  • editing of text, images, pages and document structures;
  • merging, splitting, converting and compressing;
  • applying redactions and encryption;
  • local text recognition and form editing;
  • digital signatures and visible signatures;
  • dimensioning and quantity take-off;
  • scanning, media and 3D functions;
  • batch processing;
  • a virtual PDF printer and Windows Explorer integration.

The conversion functions comprise output as JPG, PNG, TIFF, text, searchable PDF and ZIP, as well as Word files in DOCX format and Excel files in XLSX format. PDF documents can be created from images, from Office files using LibreOffice and from HPGL/2 plotter files; HPGL/2 files can also be exported. Form editing supports AcroForm fields. Document design includes, among other things, layers, watermarks, headers and footers with Bates numbering, bookmarks and the generation of QR codes and barcodes.

The dimensioning functions comprise dimension chains, areas, angles, radii and scale settings as well as VOB quantity take-off. The media and 3D functions enable STL, OBJ and PLY models to be viewed and video and audio to be embedded and played. Media playback uses Windows decoders; additional FFmpeg codecs are not supplied. Windows Explorer integration comprises preview and thumbnail views. Several documents can be edited simultaneously in tabs or separate windows.

The interface offers ten light or dark themes and customisable keyboard shortcuts. It is available in German, English and French.

Since version 1.55.3, the user's own stamps, signature images and the name used as comment author can be imported from PDF-XChange. On first start, a static offer appears once per Windows user account; no PDF-XChange data is searched for or read before that. The local search begins only after “PDF-XChange-Daten suchen und zur Übernahme auswählen” (Search for PDF-XChange data and select for import) has been activated or after the corresponding call via the command palette or the settings. Only the data selected in the subsequent dialog is imported. PDF-XChange is not modified; the data does not leave the device.

The range of functions agreed for the edition concerned is authoritative. Visible buttons or settings for locked functions do not give rise to any claim to have them unlocked.

(2) PDF editing, including the local OCR available as standard, takes place on the user's device. Cloud processing of documents is not required for these functions. Network connections may arise in particular for licensing, support triggered by the user, time-stamping services set up by the user and network scanners.

Scanners are addressed locally via WIA or TWAIN or, in the local network, via eSCL/AirScan. The models needed for the standard local OCR are contained in the program package; no models are downloaded during use.

(3) The software is provided as a Windows version. A licence entitlement that is independent of the operating system does not give rise to any claim to the development or delivery of a version for another operating system.

(4) The applicable technical requirements are:

For version line 1.55, including the documented patch levels 1.55.1, 1.55.2 and 1.55.3, Windows 10 or Windows 11 in the 64-bit x64 architecture is supported. Administrator rights are required for installation. The program folder requires approximately 380 MB of storage space; the installation file is approximately 123 MB in size. Python 3.12, Qt 6.11 and the required libraries are supplied; no separate runtime environment needs to be installed. The optional Explorer preview uses the .NET Framework 4.x contained in Windows 10 and Windows 11. LibreOffice is not supplied and is required only for the corresponding Office import. The printer and print service are set up with the aid of Windows PowerShell.

At least 4 GB of RAM is required; 8 GB is recommended, in particular for large plans, local OCR and several documents open at the same time. Also required are approximately 400 MB of free storage space, a screen resolution of at least 1280 × 800 pixels and an internet connection for licence activation and online licence verification. Offline use is governed by § 7(7).

The information on local storage and Windows integration takes into account the documented patch level 1.55.3.

(5) Individual functions presuppose additional technical requirements. These include in particular an available LibreOffice installation for corresponding Office conversions, suitable scanners and drivers, existing Windows media decoders and required certificates and, where applicable, time-stamping services. Unless these services are expressly agreed as well, their procurement and any charges are not part of the software licence.

(6) The installation or repair of the virtual printer and its system components may require Windows administrator rights. The print service is operated as a Windows system service and may start automatically with Windows.

(7) Documentation, functional descriptions and technical information describe the performance owed. A guarantee going beyond this is assumed only if the content of a statement recognisably contains such an independent guarantee. Statutory requirements on conformity with the contract and binding agreements on quality remain unaffected.

§ 5 Editions and licence models

(1) The following states of use are to be distinguished:

Edition or state Duration and access Range of functions
Pro trial period 60 days free of charge per Windows user account from the expressly triggered start after acceptance of the licence terms in the program, without a licence key and without registration The Pro functions released in version 1.55.3; no locked cloud AI services
Keyless state without a running trial period Without an activated Free or Pro key, before the start or after the end of the trial period Viewing, navigation, zoom, search, printing and media playback; no editing, converting or saving
Free Edition Right of use free of charge and unlimited in time for major version 1, but with an activated Free licence key Viewing and printing, as well as the functions released for Free for deleting individual pages, redacting and saving
Pro perpetual licence Right of use unlimited in time for the agreed version range Pro functions within this version range, including updates owed under § 10
Pro annual licence Fixed-term right of use for twelve months Pro functions during the agreed term
Pro five-year licence Fixed-term right of use for five years, exclusively for business customers/traders Pro functions during the agreed term

(2) The version range covered by the Pro perpetual licence is as follows:

The Pro perpetual licence comprises major versions 1 and 2 of MEYER | PDF, including all bug-fix and security updates of these versions. Major version 3 is optional and must be acquired separately, unless the change is required under § 10 to maintain or establish the conformity with the contract that is owed. Such necessary major version changes are made possible without any additional licence fee.

The major version range is stored technically in the signed licence package. Updates within this range are included; § 10 remains unaffected.

(3) A Pro licence entitles the user to installation and use on up to two devices within the agreed scope of users. Volume licences extend the scope only in accordance with the respective order.

The Pro licence is assigned to one person and may be used on up to two of that person's own devices. In the case of companies, it is assigned to a named employee; a change of the named employee is permitted. Simultaneous use of the same Pro licence by different persons is not permitted. The Free licence likewise applies to one person on one device of their own. The Pro trial period applies per Windows user account for 60 days from the expressly triggered start after acceptance of the licence terms in the program and requires neither a licence key nor registration.

(4) The five-year licence is offered exclusively for business use. A mere statement or selection in the order form does not change the actual statutory status as a consumer. If a consumer contract is nevertheless concluded, all mandatory consumer protection provisions remain applicable.

(5) The price, its tax treatment and the payment terms result from the offer accepted before conclusion of the contract. In relation to consumers, the applicable total price, including applicable taxes and unavoidable price components, must be shown. A contract subject to payment does not arise solely through the end of the trial period or the continued use of the keyless range of functions.

(6) The designation “licence” describes the right of use granted; it does not replace the statutory classification of the underlying contract for provision of the software.

(7) The Pro perpetual licence is a permanent provision against a one-off payment, to which the law on sale applies. Annual and five-year licences are temporary provisions against one-off remuneration, to which the law on lease applies. In the case of consumer contracts, §§ 327 et seq. BGB take precedence.

§ 6 Grant and limits of the rights of use

(1) MEYER EDV grants the user a simple, non-exclusive right to install, load, run and use the software as intended within the agreed scope of devices, users, edition and term. Sublicensing is not permitted, unless it is expressly agreed or permissible on the basis of overriding statutory or open-source rights.

(2) Reproductions required for use in accordance with the contract and required backup copies are permitted. Backup copies must not be used to exceed the agreed scope of use.

(3) Commercial document editing as intended, including for customers of the user, is permitted within a licence effectively acquired for this purpose. The creation, storage and sharing of the user's own work results does not trigger any additional remuneration to MEYER EDV.

(4) The following in particular are not permitted:

  1. use beyond the agreed scope of devices, users or term;
  2. the unauthorised passing on or making publicly available of the proprietary software or of licence keys;
  3. the rental or provision of the software itself as a service for third parties, unless this is agreed or permitted by law;
  4. the manipulation of licence packages or the circumvention of edition and term restrictions for unauthorised use;
  5. the removal of legally protected copyright, trade mark or licence notices, unless there is a statutory or licence-based entitlement to do so.

(5) Acts permitted by law remain unaffected. This concerns in particular required backup copies, observing, studying and testing the behaviour of the program and permissible decompilation to establish interoperability under §§ 69d and 69e of the German Copyright Act (UrhG). Permissible error corrections and more extensive rights under third-party software licences are not excluded.

(6) A prohibition of resale does not apply to the extent that statutory exhaustion has occurred with regard to a copy of the program and the associated right of use or the transfer is permitted by law for other reasons. In the event of such a complete transfer, the previous user may no longer use the transferred entitlement and must render the copies used for it unusable. A two-device licence acquired as a single unit may not be split into two independent licences solely on the basis of the number of devices, unless the law permits a split.

(7) To the extent that rights are protected by law, they remain with MEYER EDV or the respective right holders. This contract does not assert any exclusive copyrights in components that are not legally protected.

§ 7 Trial period, Free registration and activation

(1) The free Pro trial period begins in the respective Windows user account only when the user accepts the licence terms in the program and activates “Kostenlose 60-Tage-Testphase starten” (Start free 60-day trial period); it lasts 60 days. From the 45th day, notice may be given of its impending end. The trial period gives rise neither to an obligation to purchase nor to an automatic continuation subject to payment.

After the welcome window, a separate step offers the licence terms for reading and saving and, separately from them, the privacy information for information purposes. The checkbox for accepting the designated version of the licence terms is not preselected; the trial period can be started only after it has been selected. The consent relates exclusively to the licence terms and is not consent under data protection law. The trial start, the promised duration and the consent, together with the date, program version and identifier of the accepted version, are stored locally. A shorter trial duration subsequently transmitted by the licence server does not shorten the 60 days already promised.

A person who does not initially start the trial period may instead enter an existing licence number or close or postpone the step. Without a running trial period and without a licence, the keyless functions under § 5 remain usable. The start offer appears again at the next program start and can also be reached under “Einstellungen > Lizenz” (Settings > Licence) and when a locked function is called up. The step applies per Windows user account. A start in the background does not begin a trial period; print monitoring operates independently of this. Trial periods already begun before version 1.55.3 continue without renewed consent; where a licence exists, no acceptance for the trial period is required.

(2) Before the start and after the end of the trial period, only the keyless range of functions described in § 5 is available without an activated licence key. The additional Free functions are not automatically unlocked; a Free licence key, which is free of charge, is required for this.

(3) The Free licence key is obtained as follows:

The user enters their name and e-mail address in the web form at https://www.meyer-edv.com/meyer-pdf/free. The licence manager generates the Free licence key, which is free of charge; it is delivered to the user by e-mail.

For registration or purchase, the application refers to the website or the online shop respectively. Subsequent activation takes place in accordance with paragraph (4).

Pro licences are ordered via our online shop at https://www.meyer-edv.com/meyer-pdf/kaufen; the seller is Polar in accordance with § 3(7). The licence key is delivered by e-mail.

The Pro order requires first name and surname, e-mail address and billing address and, for companies, also the company name; stating the VAT identification number is voluntary. The user enters payment data only with Polar; MEYER EDV does not receive it. The licence manager generates the licence key after the order has been completed.

(4) For Free and Pro, the licence key is activated via the MEYER EDV licence server at https://license.meyer-edv.cloud. Initial activation requires a connection to this service. A user account within the application is not required for this.

An existing licence is governed by the licence terms agreed when it was obtained. Activation does not require new consent and does not store any consent to the EULA. This also applies on a further Windows user account and after deletion of the local licence and trial data. The licence terms are incorporated in the ordering procedure or the Free provision procedure, and not only at activation.

(5) Activation results in the local storage of a digitally signed licence package. During licensing, according to the technical status of this version, in particular the licence key, the program version and device hashes formed field by field are processed. Since version 1.55.3, two device identifiers are used for this purpose: the Windows installation identifier and the system UUID; if one of them is missing, the serial number of the system drive is used instead. The CPU identifier is no longer used. The operating system and a device name entered by the user are transmitted only voluntarily; both transmissions are switched off by default or, respectively, the name field is empty. The Windows computer name has no longer been transmitted since version 1.55.1. The underlying device identifiers are not transmitted to the licence server in plain text. However, the hashes are not to be regarded as anonymous for that reason.

(6) After activation, automatic online licence verifications take place no more than once within 14 days. They serve to verify the licence entitlement and validity and any legally justified deactivation or blocking.

(7) The absence of an internet connection alone does not invalidate an effectively activated licence. In the case of fixed-term licences, the entitlement to offline use exists until the end of the contractually agreed term; offline use does not extend the term. In the case of the perpetual licence, licence verification must not curtail the unlimited right of use through an expiry in time that has not been agreed or through an ongoing obligation of online renewal.

(8) A change of device is permitted within the agreed scope. By deactivation on the previous device, the associated device slot can be released. If this is not possible, for example because of a defect or loss, the user may contact support with reasonable proof of their entitlement.

After a reinstallation of Windows, the same computer may be technically recognised as a new device and occupy a further device slot. Old device assignments can be released by deactivation or via the customer portal.

(9) A licence may not be revoked solely at the free discretion of MEYER EDV. Restrictions presuppose a contractual or statutory ground, such as the end of the agreed term, an effective termination of the contract or substantial unauthorised multiple use. Incorrect verification results do not in themselves give rise to the loss of an existing right of use. Justified complaints are examined; statutory rights to remedy remain in place.

(10) The end of a Pro entitlement does not result in the transfer or deletion of the user's documents. However, it may prevent further editing and saving with Pro functions. Independent Free or other continuing rights of use remain unaffected.

§ 8 User content, third-party providers and locked cloud AI

(1) Rights in the user's documents and other content remain with the respective right holders. Local processing does not grant MEYER EDV any general rights of use in this content.

(2) The user must observe the rights and authorisations required for their processing. This applies in particular to third-party documents, personal data, signature images, certificates, embedded media, fonts and standards texts imported by the user. The software does not confer any rights in protected standards works and no embedding rights going beyond existing font licences.

Before an installed font is embedded, the insert dialog draws attention to its licence.

(3) To the extent that the user selects independent third-party services, for example certification authorities, time-stamping services or e-mail applications, their terms apply to the respective third-party relationship. Such use does not as a matter of course extend the scope of MEYER EDV's services. MEYER EDV's responsibility for its own services, interfaces owed and vicarious agents deployed remains in place.

The e-mail function does not send documents automatically. After a prompt in the application, the handover to Outlook, Thunderbird or eM Client opens a window for composing a message. For other e-mail applications, the handover takes place via an e-mail link without an attachment; the file concerned is highlighted in Explorer. The user initiates the sending themselves. Local copies arising in the process are governed by § 9(12) and § 12(7).

(4) The locked cloud AI functions are not part of the performance currently owed. No later unlocking, specific unlocking date or specific free quota is promised. The independent offering of an AI service by MEYER EDV does not lift the lock within this software.

The locked functions concern cloud OCR and image analysis, translations, AI-assisted form recognition and form completion, VOB support and the AI-Bemasser. The TPM function, which is likewise locked, is intended for a separate 30-day AI demo key; it is to be distinguished from the 60-day local Pro trial period. A local administrator setting alone does not enable unlocking in version 1.55.3 without release by the operator.

According to technical status 1.55.3, only MEYER EDV can release the cloud AI, either through a new program version or, for an individual licence, through a digitally signed licence release. Customers and customer administrators cannot lift the lock themselves; a local policy can only switch off the cloud AI. So far, no customer licence has been unlocked. “Freischaltung anfragen” (Request unlocking) merely opens a prepared e-mail with the licence number and program version and does not itself send it. The offer of an AI demo key does not appear in this version. Local dimension chains from vector plans remain usable without cloud AI.

(5) A later provision of cloud AI presupposes separately communicated provisions on service and data protection and, where required, supplementary agreements. Approval of a transfer by the operator replaces neither the legal basis for processing the data of all persons concerned by the documents nor required data processing or third-country transfer agreements.

For a later unlocking, MEYER EDV envisages processing via the MEYER AI Manager on its own hardware on the company premises in Neustadt am Rübenberge. For keys of MEYER | PDF customers, no forwarding to external model providers is envisaged; page images and texts are to be processed in working memory exclusively in order to generate the response and are not to be logged as content. Required customer agreements on data processing will be provided before the first unlocking. These stipulations concern a possible later unlocking, not a cloud service that is already available.

If, after a corresponding unlocking, the user themselves enters their own API key from a third-party provider, the requests concerned are sent directly from the program to that provider, not via MEYER EDV. The user is the contracting party of the third-party provider. The additional cloud consent is not given by default, applies to the cloud AI functions and can be withdrawn under “Einstellungen > KI / OCR” (Settings > AI / OCR) by removing the checkmark. This consent alone does not lift the technical lock; the local functions remain usable without it.

(6) Both parties comply with the export control and sanctions provisions respectively binding on them. MEYER EDV's own manufacturer or distribution obligations are not thereby transferred to the user.

§ 9 Care, data backup and limits of specialist use

9.1 General care and data backup

(1) The user must, within the bounds of what is reasonable, ensure that important original files and work results are backed up independently of ongoing editing. The type and frequency of backup depend in particular on the importance and extent of change of the data and on the available backup options.

(2) Before irreversible editing steps and extensive batch processing, suitable backup copies should be made and settings should first be checked using suitable sample files.

(3) Automatic recovery generally saves unsaved changes; the preset interval is five minutes and can be changed. It is neither a complete backup nor an audit-proof archive and does not replace independent data backup.

Automatic saving can be switched off. Recovery files are stored locally and deleted after successful saving, when the document is closed or when the program is exited. Files remaining after a program crash are offered for recovery at the next start. They are also deleted if this offer is declined or after successful recovery; the working copy used during recovery is located in the private session folder and is deleted together with it in accordance with the rules in § 12(7). For password-protected documents, the recovery files are encrypted.

(4) Passwords, signature keys and other means of access must be adequately protected. The loss of a password or private signature key may prevent further access or further use, as the case may be. Recovery by MEYER EDV is not owed solely on the basis of this contract.

9.2 Redactions and confidential documents

(5) The redaction function serves to remove the selected content from the edited output document. The mere marking of an intended redaction is to be distinguished from actually applying it.

(6) Redacting an output file does not automatically delete existing originals, other file versions, backups, print stores or support copies. Before confidential documents are shared, the output file actually generated and, where applicable, further information contained in it, in particular metadata and attachments, must be checked to a reasonable extent. The functionality of the redaction that is owed is not restricted by this.

9.3 OCR, conversions, quantity take-off and dimensioning

(7) The local model-based text recognition is an AI-assisted function. Recognition and conversion results may contain errors, in particular in the case of poor originals, unusual typefaces, tables, digits and complex layouts.

Local OCR recognises existing content and does not generate new content. Under “Hilfe > KI-Einweisung” (Help > AI briefing), a printable short briefing is available on how it works, its limits and possible errors, and on the locked cloud functions.

(8) Quantity take-off and dimensioning results depend, among other things, on the correct plan revision, scale, the units chosen, reference points and calculation conventions. The software does not replace specialist examination of the underlying planning or any required on-site survey.

The dimensions are determined by calculation from the drawing and the stored scale. MEYER | PDF does not determine whether the plan shows shell-construction or finished dimensions or which set of rules, in particular VOB or DIN, is to be applied. The CSV export lists the source plan, creation date, scale per page, unit and reference; a set of rules is designated as “nicht festgelegt” (not specified), except for imported VOB entries with edition and source.

(9) Business customers/traders must have results checked by competent persons to an extent appropriate to the risk of use before using them for construction work, binding offers, billing or comparably significant decisions. This includes in particular plausibility checks of the scale, essential quantities and the relevant shell-construction/finished-construction conventions.

(10) Consumers are recommended to carry out a corresponding check of important results. No general business-type duty of examination or organisation is thereby imposed on them.

9.4 Signatures, print service and Windows integration

(11) A visible signature image is not to be equated with a qualified electronic signature. The PAdES format alone likewise does not constitute a qualified electronic signature. Its requirements depend in particular on the certificate used, the creation of the signature and the relevant statutory requirements. A technical validation display does not replace a legal examination of the specific intended use.

MEYER | PDF does not create qualified electronic signatures. An inserted signature image is merely an image, not a digital signature and not proof of who signed.

Signature validation is not available as a program function in this shipped version. The program does not perform any OCSP, CRL or certificate retrievals from certification authorities; no revocation information is embedded or retrieved during signing. Certificate or revocation list caches are not created. During digital signing, a time-stamping service is addressed only if the user enters a corresponding server; in that case the hash value of the signature is transmitted to the address specified by the user. No time-stamping service is preset. Windows may additionally perform its own revocation checks for the program signature.

The path of the certificate file, the associated password, the reason for signing and the time-stamp address entered are not stored.

(12) The virtual printer uses the Windows system service MeyerPdfSpoolSvc and a local communication interface. Print jobs that can be unambiguously attributed to a user are stored individually in a user-specific store. This store is not an independent backup.

The private print store is located in the respective Windows user profile at %LOCALAPPDATA%\MEYER\spool. Print jobs arriving in parallel are also stored separately. Other standard Windows users have no access to this store. The application running in the notification area reads in its own print jobs and asks whether the PDF is to be opened, saved, sent by e-mail or discarded. Local service communication does not open a network port.

Print jobs that have not been processed remain stored without automatic age-based deletion and are offered again at each program start. Opened or discarded jobs are deleted from the print store; upon successful saving, the file is moved to the selected storage folder. The e-mail handover creates a permanent copy in the storage folder, by default in the “Dokumente” (Documents) folder. The intermediate store of the print service is emptied after delivery.

If the print service cannot unambiguously attribute a job to a user, the job is not delivered and is not automatically delivered later either. It remains stored with its complete document content in the protected local service store at %ProgramData%\MEYER\spoolsvc\recv. Only the operating system and administrators can access it. The program does not display such withheld jobs, does not delete them after a period of time and does not send reminders of a review period.

For withheld jobs, the organisational procedure provides for a review by the competent administration within 30 days of receipt. Release takes place only to persons who are unambiguously entitled; jobs and backup copies no longer required are deleted. If the attribution remains unclear, the competent body decides on a further fixed-term retention with a fixed end date or on deletion. The 30 days are an organisational review period, not an automatic deletion period of the software. Behaviour on uninstallation is governed by § 18(9).

In the program packages of versions 1.55 to 1.55.2, a module required for user attribution was missing. According to the analysis of these packages, print jobs were therefore withheld in the service store instead of being displayed in the program. Version 1.55.3 rectifies this error for new jobs. The update does not automatically deliver documents already withheld. In the case of missing print jobs, the competent administration can check the protected service store; assistance is available via info@meyer-edv.com. Statutory rights remain unaffected.

In the Windows print queue, a job sent to “MEYER PDF” remains only until it is accepted by the broker service; Windows then deletes it there. Retention of printed documents in this queue is switched off. Print jobs sent to other printers are managed by the respective driver or by Windows.

(13) The service channel can be addressed directly by locally authenticated users. In doing so, they do not obtain any rights to change the channel permissions or the owner and no rights to create further channel instances. The software is intended as a single-workstation application and not as an independent security boundary between untrusted tenants. This notice entails neither an assumption of manufacturer security risks by the user nor a waiver of rights in respect of defects.

(14) Windows may block the Explorer preview for files with an internet marking. An unblock function offered should be used only for trustworthy files. A general deactivation of operating system protection mechanisms is not presupposed.

The Explorer preview and thumbnail view are activated by default in the installer but can be deselected there. They can also be switched off under “Einstellungen > Allgemein” (Settings > General) and are removed on uninstallation.

In the installer, the desktop shortcut, the virtual PDF printer including the broker service and the Explorer right-click menu “MEYER PDF” are also selected by default and can be deselected. Irrespective of these selection options, a machine-wide “Öffnen mit” (Open with) entry is set up for PDF files. Uninstallation removes these integrations.

At the first program start, a user-specific Explorer right-click menu, an autostart entry for the application in the notification area and a scheduled task for starting the program when printing to “MEYER PDF” are additionally set up without a separate prompt. The user-specific context menu can be removed under “Einstellungen > Allgemein > Explorer-Kontextmenü entfernen” (Settings > General > Remove Explorer context menu). Deselecting “Autostart” under “Einstellungen > PDF-Drucker” (Settings > PDF printer) removes both the autostart entry and the print start task. By contrast, setup as the default PDF application takes place after a prompt. The one-time unblocking of an Explorer preview blocked by the internet marking and the repair of an old printer likewise take place after a prompt; preview unblocking removes only the internet marking and does not change the document content.

At the first program start, a neutral welcome window appears with notices on backup copies and on licence verification in Germany, as well as links to the licence terms and privacy information. It appears before the first licence verification and does not halt the program. Activation of the “Zur Kenntnis genommen” (Acknowledged) button is stored once per Windows user account. Since version 1.55.3, the window additionally contains an embedded notice on licence verification; no contact with the licence server takes place before it is displayed. The acknowledgement is neither an acceptance of the EULA nor consent under data protection law. The separate start of the trial period is governed by § 7(1).

(15) The acts of cooperation described in this section do not replace the error-free performance owed by MEYER EDV. The effects of a failure to cooperate on claims for damages are determined exclusively by § 16 and the statutory requirements.

§ 10 Updates, major versions and support

(1) MEYER EDV provides the contractually agreed and legally required updates. These include required security and functional updates and the information on their availability that is owed by law.

(2) For consumers, the update period is determined by the statutory provisions and the agreed type of provision. In the case of continuous provision, required updates are owed during the provision period. In the case of one-off provision, the period applies that the consumer can expect, taking into account the type and purpose of the digital product and the circumstances and nature of the contract.

(3) To the extent that a change to a new major version is required to maintain or establish the conformity with the contract that is owed, it is made possible without any additional licence fee. Necessary major version changes already promised free of charge remain in place. They may not be excluded either by a new version of the contract or by renaming the update.

(4) New functions that are not required, independent add-on products and optional major version changes may be offered and remunerated separately, unless they already form part of the agreed scope of services. An unlimited right of use is not a promise of all future extensions or of voluntary support unlimited in time.

(5) MEYER | PDF 1.55.3 does not perform any independent update query in the background. Information on updates is provided via the website; a notice of available updates via the licence server has not yet been implemented in version 1.55.3. Statutory obligations to inform about required updates exist independently of this technical implementation. A permanent online connection is not presupposed.

(6) If a consumer does not install a provided update within a reasonable period, the consequences are determined exclusively by the statutory requirements. Exoneration of MEYER EDV presupposes in particular that the defect concerned is based solely on the failure to install, that the consumer was properly informed about the update and the consequences of failure to install, and that the failure to install or incorrect installation is not based on defective installation instructions.

(7) An update may not, without an effective legal basis, withdraw essential agreed functions or curtail the acquired right of use. Statutory rights in the event of changes to digital products remain unaffected.

(8) Support is offered via the contact channels stated in § 2. Without a separate agreement, no specific response times, on-site services, training, individual adaptations or data recovery services are promised. Statutory and contractual obligations regarding provision, updating and remedying of defects are not thereby limited.

(9) For business customers/traders, the statutory level of performance and the level of performance promised above apply; an additional maintenance contract is not part of this contract. Statutory update obligations and updates already contractually promised remain unaffected. Necessary updates and necessary major version changes are not additional maintenance subject to payment.

§ 11 Third-party components and open source

(1) The software contains or uses components of third parties. These remain under their respective licences. To the extent that such a licence grants the user more extensive rights, these rights take precedence over the restrictions of this EULA for the component concerned.

(2) The named components include in particular:

Component Licence attribution
Python runtime environment, pywin32 PSF-related licence terms of the respective component
PySide6 / Qt for Python LGPL-3.0
shiboken LGPL-3.0
pypdfium2 / PDFium Apache-2.0 and BSD-3-Clause, depending on the constituent part
pikepdf MPL-2.0
qpdf Apache-2.0
NumPy, qrcode BSD-3-Clause
opencv-python-headless, rapidocr-onnxruntime Apache-2.0
ONNX Runtime, pyHanko, pyhanko-certvalidator MIT
cryptography Apache-2.0 / BSD-3-Clause
Pillow HPND, also referred to as MIT-CMU
python-docx, openpyxl, python-barcode, pyzipper MIT
zeroconf LGPL-2.1
opentelemetry-api, from 1.55.2 Apache-2.0
Jost font SIL Open Font License 1.1
PyInstaller bootloader, where shipped GPL with the applicable runtime exception

(3) This overview replaces neither the complete licence texts nor the copyright and NOTICE statements. For the constituent parts actually shipped, including sub-components, model weights and other data packages, the version-specific third-party component directory is authoritative.

The originally shipped version 1.55 did not yet contain the complete licence and copyright texts offline. Since the corrected release 1.55.1, the complete directory with 81 components, compiled from the package state actually shipped, has been located in the folder “Lizenzen” in the program folder. It can be reached in the application under “Hilfe > Drittsoftware” (Help > Third-party software). The files Drittsoftware-Lizenzen.html and KOMPONENTEN.txt contain the overview; the complete original licence texts, copyright notices and NOTICE files are also located there. Sub-components and data packages are included, in particular the PDFium sub-components, qpdf, the PP-OCRv4 OCR models, the German dictionary and the Jost fonts. LibreOffice is not supplied.

With version 1.55.2, the directory comprises 82 components. “opentelemetry-api” has been added as a library dependency; this interface component does not contain a telemetry exporter and does not transmit any data.

(4) To the extent required by the respective licences, MEYER EDV provides the associated source code, including required modifications, build files and further materials owed under the licences.

The source code of the LGPL/MPL components shipped for 1.55, 1.55.1, 1.55.2 and 1.55.3 is accessible free of charge and without registration on MEYER EDV's own server: https://opensource.meyer-edv.cloud/MEYER-EDV-GmbH/meyer-pdf. Provided are the unmodified upstream source archives of the exact versions used, Qt 6.11.2, PySide6 and shiboken6 6.11.2, zeroconf 0.151.5 and pikepdf 10.16.0, including the build and installation files contained in the archives. Attribution to the respective binary package is made via separate program version folders and the associated archive references; checksums and details of upstream origin are enclosed. The accompanying file CORRESPONDING_SOURCE.txt explains the library versions used, their unmodified adoption and their integration as replaceable libraries.

The direct download links are contained in QUELLCODE-DRITTSOFTWARE.txt. Since the corrected release 1.55.1, this information has been available in the “Lizenzen” folder, under “Hilfe > Drittsoftware” (Help > Third-party software), before installation on an information page of the installer and directly next to the installer at the download location. Users of the original version 1.55 can also retrieve its source archives without a program update; attention is drawn to this on the download page and in the changelog. Access remains available for as long as the respective program version is offered; older version folders are not replaced. The private application repository is not the source from which recipients obtain the source code.

(5) In particular, the modification and replacement of corresponding libraries permitted under the LGPL, as well as the reverse engineering required for debugging such modifications, remain permitted. The general restrictions in § 6 do not apply to this contrary to the respective licence.

The Qt libraries are present in the installation as separate, replaceable files in the program folder.

(6) A claim to the proprietary application source code exists only to the extent that it is separately agreed or results from mandatory law or applicable third-party software licences.

(7) Exclusions of liability or warranty in third-party software licences concern the respective licence relationship with the right holders named there. They do not remove MEYER EDV's own statutory or contractual obligations for the overall performance owed.

§ 12 Data protection and local storage

(1) Ordinary document editing takes place locally. MEYER | PDF contains no advertising and no usage analytics telemetry. To be distinguished from this are the processing of licensing data and the receipt of data that the user transmits to support.

(2) The mere provision of locally used software does not make MEYER EDV the controller or processor of all of the user's document content. Responsibilities for actual transmissions and services are to be assessed separately.

(3) Local settings may contain, among other things, file paths, form details and the comment author. By default, the Windows login name may be used as the comment author. Such author details may form part of a PDF document shared later and should be changed beforehand if necessary.

The settings are stored in the user-specific Windows registry. Stored API keys are encrypted with Windows DPAPI in a user-bound and device-bound manner and are not logged. If DPAPI encryption fails, the key is not stored; the user receives a visible notice. Legacy plain-text values from earlier versions are encrypted at program start. An expired AI demo key is automatically removed at program start.

The application automatically stores a list of recently opened files, the last save folder, interface settings, the support contact, the last scan profile and the last batch job without its files and passwords. The recent files list cannot be switched off; entries can be removed individually in the open dialog or completely under “Einstellungen > Pfade” (Settings > Paths). The freely completable form profile “Meine Formulardaten” (My form data) and the user's own stamps remain stored until changed or deleted by the user. The form profile can be cleared or reset to the template; stamps can be deleted individually, after which the standard stamps appear.

In the import from PDF-XChange described in § 4(1), selected stamps and signature images are stored locally in the user profile at %LOCALAPPDATA%\MEYER. The stamp list and an imported comment author are stored in the user-specific program settings.

(4) Local logs may contain file paths and technical details. Support archives may additionally include screenshots, screen recordings or document copies, insofar as these are included. No automatic transmission of crash reports takes place. Before a self-initiated transmission, the user should check the data contained and remove confidential content that is not required.

The logs do not contain any document content. Local program logging is always active as shipped and cannot be switched off; only detailed debug logging is switched off by default and can be changed under “Einstellungen > Protokoll” (Settings > Log). Older program log data is overwritten during rotation; it can also be removed via “Protokolle leeren” (Clear logs). The print service additionally maintains a size-limited rotating log at %ProgramData%\MEYER. This log and the setup logs stored there are removed on uninstallation. The Explorer preview maintains its own diagnostic log with the paths of displayed PDF files at %USERPROFILE%\AppData\LocalLow\MEYER\logs. This log is cleared when it reaches its size limit and is also covered by “Protokolle leeren” (Clear logs).

Upon user action, the support tool creates a local, unencrypted ZIP archive containing the included details of the request, the system and the program state, as well as the selected further diagnostic content. Secrets are masked in the process. No upload destination is configured as shipped; no upload takes place. Sending is carried out exclusively by the user via their e-mail program to info@meyer-edv.com. For this purpose, the support tool opens an e-mail link without an attachment and highlights the ZIP archive in Explorer; the user attaches it themselves and triggers the sending. Actively created local support reports and archives are automatically deleted after 30 days.

In addition, local error reports are automatically created in the event of unhandled program errors. They contain the program state, including document path or title, page counts, last actions and settings with masked secrets, the error message and the log; personal settings such as the recent files list, form profile and comment author are excluded. A screenshot of the program window is enclosed only if the user expressly switches this on; this option is switched off by default. Such a screenshot may show the visible document page; the document file itself is not enclosed with the automatic error report. Automatic local creation is switched on by default and can be switched off under “Einstellungen > Protokoll > Automatische Fehlerablage” (Settings > Log > Automatic error storage). No automatic transmission takes place. At most the last five error reports are automatically retained, and none for longer than 14 days. “Support-Berichte leeren” (Clear support reports) deletes the entire local support folder, including reports and archives stored there.

(5) Acceptance of this EULA is not blanket consent under data protection law. Required separate consents and information on access to terminal equipment are not replaced by this contract.

(6) Processing by MEYER EDV is governed by the program-specific privacy information:

The complete privacy information for MEYER | PDF is made available upon publication of version 1.55.3 at https://www.meyer-edv.com/meyer-pdf/datenschutz as a web page and as a PDF for saving. It is intended to be viewable there even before licence activation and before any transmission to support. In program state 1.55.3, the privacy information is directly linked in the welcome window before the first licence verification, under “Hilfe > Datenschutz” (Help > Privacy), in the “Lizenz” (Licence) tab directly at licence activation, in the support dialog before sending, at the cloud AI consent in the setup and the settings, and in the legal notice (Impressum). Access under “Hilfe > Datenschutz” (Help > Privacy) is also possible without a licence and without an open document. In the separate step for starting the trial period, the privacy information is linked separately from the licence terms to be accepted, exclusively for information purposes.

The website's privacy policy is available at https://www.meyer-edv.com/datenschutz. It does not replace the required program-specific information to the extent that the processing concerned is not fully described there.

(7) Stamp images, signature images, cached texts of standards files stored by the user, licence packages, recovery files, logs and support archives are stored locally in the user profile at %LOCALAPPDATA%\MEYER. Drawn or loaded signature images remain permanently stored and can be deleted under “Einstellungen > Unterschriften” (Settings > Signatures). The activated licence package is stored locally until deactivation or until expiry; it can also be removed using the function for deleting licence and trial data described in § 18(9).

For print, Office conversion, preview, media, scan and e-mail operations, as well as when creating new documents and when importing clipboard images, files may additionally arise in the Windows temp directory. Local OCR does not create any temporary files. The temporary working files of a program session are located in a private session folder at %TEMP%\MEYER-PDF. These include in particular preview, thumbnail, page order and translation copies, Office conversions including the LibreOffice profile, unnamed documents, clipboard images, scan pages, unpacked media and intermediate states of batch processing. The session folder is deleted when the program is exited. After a crash, the application removes the folders of ended sessions at the next start and during subsequent regular checks. Scan pages are deleted after they have been imported; in the event of cancellation or errors, they are removed together with the session folder.

Working copies of password-protected documents remain encrypted. This applies in particular to preview, thumbnail, page order and translation copies as well as support document copies and e-mail attachment copies; the password is held only in working memory.

Excepted from the session folder are e-mail attachment copies in the Windows temp directory, because some e-mail programs read the attachment only when sending. In the case of changed or unnamed documents, such a copy is created for the e-mail handover, with the same protection in the case of password-protected documents; unchanged saved files are attached directly. The attachment copies are automatically deleted after 24 hours. Program-specific temporary remnants of older versions are deleted after 48 hours. “Temporäre Dateien bereinigen” (Clean up temporary files) in the settings immediately removes the folders of ended sessions and the program-specific temporary remnants, including e-mail attachment copies. Windows manages the Windows Explorer's own thumbnail cache; it can be cleaned up via Windows Disk Cleanup. Recovery files are governed by § 9(3); data remaining after an uninstallation is governed by § 18(9).

§ 13 Provision and rights in respect of defects for consumers

(1) Consumer contracts on digital products are governed, to the extent that their scope of application is engaged, by the statutory provisions of §§ 327 et seq. BGB. This may also be the case for a product provided without payment of money if personal data is provided, or its provision is promised, under the statutory requirements.

(2) The statutory rights exist against the respective contracting party. The statutory rights in the event of non-provision, material defects and defects of title, and failure to provide required updates remain undiminished. These include, under the respective statutory requirements, in particular subsequent performance, termination of the contract, price reduction, damages and reimbursement of futile expenditure.

(3) A free trial option, the use of open source, a low error frequency or a general awareness of risks typical of software do not exclude rights in respect of defects.

(4) Deviations from objective requirements for a digital product can be agreed with consumers only under the statutory requirements. In particular, general notices in this EULA do not replace the required special pre-contractual information and an express, separate agreement under § 327h BGB.

(5) For consumers, this EULA neither shortens statutory periods for defects nor establishes additional duties of examination or notification of defects.

§ 14 Right of withdrawal and consumer information

(1) In the case of a distance contract or a contract concluded away from business premises, consumers are generally entitled to a statutory right of withdrawal. The requirements, start and duration of the withdrawal period and any statutory exceptions are determined by the applicable provisions.

(2) In the case of a purchase for payment via our online shop, Polar is the contracting party to the purchase contract; you receive the information on the right of withdrawal required for this in the order process and with the confirmation of the contract. MEYER EDV GmbH is the licensor; statutory rights under separate contracts with MEYER EDV remain unaffected. This EULA does not replace this information.

(3) In the case of digital content for payment that is not provided on a physical data carrier, premature expiry of the right of withdrawal occurs only if all statutory requirements are met. These include in particular the required express consent to the start of performance of the contract before expiry of the withdrawal period, confirmation of knowledge of the associated loss of the right of withdrawal and the legally required confirmation of the contract.

(4) Acceptance of this EULA, mere installation, activation or the prior use of the free trial period do not replace these separate declarations. In particular, the trial period does not remove the right of withdrawal in respect of a contract for payment concluded later.

(5) Legally required electronic options for withdrawal and termination remain unaffected. Their provision is not replaced by a clause of this EULA.

You can reach the electronic withdrawal function for this purchase via the access point designated in the order process and in the confirmation of the contract; other legally permissible means of withdrawal remain open.

§ 15 Rights in respect of defects for business customers/traders

(1) For business customers/traders, the statutory rights in respect of defects of the respectively relevant type of contract apply, unless an effective special provision is made below. In relation to MEYER EDV, this section concerns the performance owed by MEYER EDV under § 3(7); claims under the purchase contract with Polar remain unaffected.

(2) In the case of provision to be classified under the law on sale, MEYER EDV must, within the framework of the statutory requirements, first be given the opportunity for subsequent performance. MEYER EDV may, at its own choice, effect subsequent performance by remedying the defect or by providing a defect-free version. It must take place within a reasonable period and must not unreasonably impair the agreed use. Statutory rights in the event of failure, refusal, impossibility or unreasonableness remain in place.

(3) Business customers/traders should describe defects as comprehensibly as possible, stating the version concerned, the environment used and the reproducible steps. A more extensive examination, surrender of confidential documents or remote access option may be demanded only to the extent that this is necessary and reasonable for remedying the error and the required confidentiality and data protection measures have been taken.

(4) Commercial duties of examination and notification of defects apply only to the extent that their statutory requirements, in particular under § 377 of the German Commercial Code (HGB), are actually met. Mere status as a business customer/trader is not sufficient for this.

(5) Unauthorised modifications, the replacement of a library that may permissibly be replaced or use with third-party software do not result in a blanket loss of rights in respect of defects. However, MEYER EDV does not have to answer for a circumstance caused exclusively by a modification for which the user is responsible or by an environment contrary to the contract.

(6) Claims of business customers/traders in respect of defects relating to software provided permanently become time-barred twelve months after delivery. This does not apply in the case of fraudulent concealment of a defect, to claims under an assumed guarantee, to claims for damages and reimbursement of expenses, to mandatory statutory recourse claims, in particular under §§ 445a, 445b and 478 BGB, or to the extent that mandatory law precludes a shortening. Promised updates are not curtailed by this.

(7) In the case of annual and five-year licences of business customers/traders, no-fault liability for damages for defects already existing at the conclusion of the contract under § 536a(1) alternative 1 BGB is excluded; the cases stated in § 16(1), the maintenance obligation, liability for fault and the other statutory rights remain unaffected.

§ 16 Liability and data loss

(1) The following contractual limitations of liability do not apply:

  1. in the event of intent or gross negligence;
  2. in the event of damage resulting from culpable injury to life, body or health;
  3. in the event of fraudulent concealment of a defect;
  4. to the extent of an assumed guarantee;
  5. for claims under the German Product Liability Act (Produkthaftungsgesetz);
  6. for claims under Art. 82 GDPR (DSGVO) and other liability, to the extent that it may not be excluded or limited by law.

In these cases, the statutory provisions or the assumed guarantee, as the case may be, apply.

(2) In the event of a slightly negligent breach of a material contractual obligation, MEYER EDV is liable for compensation of the damage that was foreseeable at the conclusion of the contract and is typical for the contract. Material contractual obligations are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the user may regularly rely.

(3) In all other respects, liability for damage caused by slight negligence is excluded, unless paragraph (1) applies.

(4) No blanket limitation to the licence price is agreed. Data loss, loss of profit, business interruptions and indirect damage are not excluded from compensation solely on the basis of their designation; the foregoing requirements are authoritative.

(5) The same standards of liability apply to loss of, damage to or unusability of data. If a culpable breach of reasonable duties (Obliegenheiten) of data backup or damage mitigation has contributed to the occurrence or increase of the damage, the consequences are determined by § 254 BGB. In particular, actual backup options, causation, respective shares of fault and the legitimate expectation regarding the backup or recovery functions of the software must be taken into account.

(6) The mere absence of a current backup does not automatically result in the loss of all claims. Nor is it conclusively presumed across the board that every instance of damage would have been avoidable with a backup. In the case of consumers, no business-type backup or organisational standards are presupposed.

(7) These liability provisions apply, irrespective of the legal basis of the claim, also in favour of the statutory representatives, employees and vicarious agents of MEYER EDV, to the extent legally permissible.

(8) Statutory rights in respect of defects to subsequent performance, price reduction or termination of the contract are not excluded by the limitation of claims for damages. Directly applicable statutory particularities of an actually gratuitous provision are determined by § 17.

§ 17 Special rules for actually gratuitous provision

(1) The Free Edition and the Pro trial period are offered without a licence fee. This alone gives rise neither to a comprehensive exclusion of warranty nor automatically to the application of the law on gift (Schenkung).

(2) Nor does this alone give rise to any extension of statutory liability privileges to services provided for payment.

(3) The gratuitous loan (Leihe) is governed in particular by §§ 599 and 600 BGB: to that extent, MEYER EDV is liable only for intent and gross negligence; § 600 BGB applies to fraudulently concealed defects.

(4) These statutory privileges are not extended to contracts for payment, to additional services actually remunerated or to consumer contracts in respect of which mandatory provisions on digital products stand in the way of this. Mandatory non-contractual liability remains in place. The provisions do not establish any exemption from liability going beyond the statute.

(5) The Pro trial period and the Free Edition are gratuitous grants of use in the sense of a gratuitous loan (Leihe) (§§ 598 et seq. BGB), not a gift (Schenkung); paragraph (3) applies to both. Personal data is processed for this only for the provision, licensing and statutory obligations. To the extent that §§ 327 et seq. BGB nevertheless apply in the case of consumers, they take precedence.

§ 18 Term, termination and its consequences

(1) The Pro trial period ends after 60 days without notice of termination and without any automatic obligation to pay.

(2) The Pro perpetual licence exists without limit in time within its agreed version scope. The discontinuation of distribution or of voluntary support services does not end the right of use. MEYER EDV does not acquire any free right of ordinary termination in respect of a fully acquired perpetual licence.

(3) Annual and five-year licences are remunerated once and exist for the agreed period. The licence ends on the agreed date and is not automatically renewed. The start and end must be clearly communicated to the user before conclusion of the contract.

The technical expiry date is stored in the locally stored, signed licence package.

The term of the annual and five-year licence begins with the issue of the licence key upon purchase, and not only with its initial activation. The binding end date is shown in the order confirmation and in the program under “Einstellungen > Lizenz” (Settings > Licence) as “gültig bis” (valid until).

(4) A continuation after the end of the term requires a new purchase and a new licence key.

(5) Statutory rights to extraordinary termination or other termination of the contract for good cause remain in place. If the cause consists in a breach of duty that can be remedied, a reasonable period for remedy must generally be set beforehand or a formal warning must be given, unless this is dispensable under the statutory provisions. An insignificant breach of duty does not automatically result in the loss of the licence.

(6) Notices of termination and other declarations of termination may, unless another form is mandatory, be addressed in text form to info@meyer-edv.com. Statutory simplified options for making declarations are preserved.

(7) After effective termination, the user may no longer use the proprietary edition affected by the termination. Continuing rights to another edition, to the keyless range of functions and to open-source components remain unaffected. To the extent that no entitlement of use whatsoever continues to exist, the program copies affected by this must be removed; legally permissible evidentiary and archiving purposes remain reserved.

(8) Rights in user documents remain unaffected by the termination of the contract. Statutory claims for repayment, surrender and other settlement are not excluded. Voluntary non-use or uninstallation does not in itself give rise to any additional claim for reimbursement.

(9) Before an uninstallation, print jobs and other local work results that are still needed must be backed up. Uninstallation preserves the user-specific user data: the user-specific registry settings, including stored licence and API keys, as well as the folder %LOCALAPPDATA%\MEYER are preserved. This also concerns the private print store, logs, recovery files, support archives, stamp images, signature images, standards text caches and licence files. What is removed is the former shared print store at %ProgramData%\MEYER\spool, not the current user-specific print job store. In addition, the print service and setup logs at %ProgramData%\MEYER are removed.

The following applies to the protected service store at %ProgramData%\MEYER\spoolsvc from version 1.55.3: if no withheld print jobs exist, the folder is removed. If such jobs exist, the interactive uninstallation warns of their final deletion and deletes them only after express confirmation; the preset is not to delete them. Without confirmation and in the case of a silent uninstallation, the jobs are preserved with their access protection. They may be the only existing copy of a document. The uninstallation programs of versions 1.55 to 1.55.2 likewise leave this service store in place.

There is no function for completely resetting all settings. Individual deletion and reset functions are available, for example for the recent files list, keyboard shortcuts and the user's own AI providers or key fields. Since version 1.55.3, “Einstellungen > Pfade > Lizenz- und Testdaten löschen” (Settings > Paths > Delete licence and trial data) removes the locally stored licence package, the local product information, trial counters, the record of consent to the trial period and the device name. Deletion does not end any existing contract. An existing licence can afterwards be activated again without new acceptance of the licence terms; a new trial period starts only after renewed express consent. Registry settings no longer required under HKCU\Software\Meyer\MeyerPDF and data in the MEYER folder can be deleted manually. In doing so, only the files no longer required are to be removed; statutory retention obligations and, where applicable, data of other applications must be observed.

§ 19 Applicable law, place of jurisdiction and consumer dispute resolution

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) In relation to consumers, this choice of law applies only insofar as they are not thereby deprived of the protection of mandatory provisions of the state of their habitual residence, to the extent that these would be applicable without the choice of law.

(3) Exclusively for users who are merchants (Kaufleute), the registered office of MEYER EDV is agreed as the exclusive place of jurisdiction, to the extent permitted by law. For consumers and other non-merchants, the statutory places of jurisdiction apply. Mandatory rules on international jurisdiction remain unaffected.

(4) The following applies to participation in consumer dispute resolution proceedings:

MEYER EDV is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 20 Final provisions

(1) Amendments to this contract require an effective agreement. MEYER EDV has no general right to replace the terms unilaterally by publishing a new version, by a program update or by the mere continuation of use.

(2) Statutory rules on the precedence of individual agreements remain applicable even if a particular form is provided for in the rest of the contractual relationship.

(3) Should a provision of this contract be or become invalid in whole or in part, the remaining provisions remain effective in accordance with the statutory provisions. The statutory rules take the place of an invalid provision. An automatic replacement by a clause that is as economically similar as possible and places a more extensive burden on the user is not agreed.
